Hopefully my son has learned a lesson. I think he has but I can not be 100%sure. As for me I do not even drink. All I was saying was that if I was pulled over and had been drinking I would not do any tests. I do not think that most people are aware of their rights. I was not. I thought that you had to do all the tests. I think more people should know their rights and not be misled by vigilante police looking to arrest people. I do not know but if 1 policeman has 60-65% of the DUI arrest in a town he is on a mission to skrew with people. 2007 STATS 278 DUI arrests specific policeman 171 arrests

Beware of reading too much into partial statistics.
Perhaps he was assigned by his supervisor to focus on DUIs.
Perhaps he is the main patrolling officer during peak DUI hours.
Perhaps he is the most trained DUI investigator and is called upon by other officers to perform FSTs and be the arresting officer of record.

It is harder to prove the case without BAC evidence, but by no means impossible. Trial will be more expensive for you but if there is a reasonable chance of success and you have the money, it may be worth doing.

My agency has more than 80% of our DUI arrests performed by three officers ... it also just so happens that they tend to work the swing and grave shifts on Friday through Sunday ... that's why they get so many.

In a small town it is not surprising that so many will be done by one officer. In a large town, it would be more surprising unless the officer is assigned to a dedicated DUI car in which case he may be the guy called to ANY possible DUI stop. The question is not how many DUI arrests he has made, but how good the investigations are.

Oh, and as for being on a mission, YOU sit over the remains of what was once a mother and two small children, hold a mortally injured 6 year old in your lap as he breathes his last breaths, and behind you listen to the ranting drunk that killed them all scream that you violated his rights by cuffing his sorry ass in the middle of the F'ing road. You live with that kind of a memory and then try NOT to be on a mission! I have zero sympathy for DUI drivers and find there to be ZERO justification for such an act. None.

Your son is lucky you apparently live in a jurisdiction where they will not force blood. I live and work in one where we will - thank God. If you refuse, we will document the refusal so you get a suspension for a year AND we will hold you down and take the evidence anyway.

Same thing my attorney thought. So I wrote him the big check. A couple months later, he suggested that I take the offer the prosecution had made from the get-go.

I HATE DRUNK DRIVERS

That being said, the officer will testify that the defendant was driving in an erratic manner. And, after the stop, he noticed the odor of an alcoholic beverage, (In my job we were told alcohol is odorless, so always say beverage)
And that the defendant’s eyes were glassy and his speech slurred, ETC.

Many Many years ago the cop had to testify the above and if convincing enough the AOB test results were opened to decide depth of penalty.

He does not get a pass for not taking the test.

You are trying to throw the officer under the bus!! Skrew with people??? Notice you didn't say innocent people.

If he is pulling over people that have been drinking and then cites them for it ....(hooray for him by the way)...how is that screwing with people???

THEY ( YOUR SON INCLUDED ) ARE BREAKING THE LAW!!!

and as Carl has testified, OFTENtimes with very serious consequences.

Having been hit by a drunk driver as a child, that was going 55MPH in a residential neighborhood, as I was riding my bike, I guess you could say I am on a mission as well. I am lucky to be alive, and was in a full cast for 4 months!You talk about rights...what about my rights??? Guess they didn't count, nor the poor victims Carl talked about.

So quit banging the drum against this police officer that is doing his job, and bang some sense into that child of yours head!!!

I hope he loses his license for the full year, and has to pay some hefty fines.MAYBE THEN HE WILL LEARN THE LESSON???

drunk drivers


Maybe they should throw him in jail for 3-6 months, then maybe he will learn his lesson... Next time maybe he will kill someone and you will lose your house and property because of trying to help defend him? Get him into alcohol abuse program now before he ruins your life and maybe someone elses.... just a thought...
