Question

underage driver not at fault


What is the name of your state? OKlahoma
my underage-unlicensed 15y/o was hit by a 17unlicensed h.s. dropout. I have full coverage and the other boy's dad has insurance but he has not contacted them and I have turned in all the paperwork. The other boy was speeding and admitted it was all his fault, he claimed his brakes went out but on the report it noted the car was normal. Is his dad's insurance obligated to pay for my truck because he was at fault? He was not listed as exempt from his insurance and his dad got his car out of the impound. Need any information.

Did you file a police report? If not you should have.

You can contact his insuance to file a report. You can pick up the paper work at your local police station to file a report. You don't have to wait for the father to file.
The 17 year old being a h.s. drop out has nothing to do with this. Since it was an underage diver with no license driving your truck (with or with out permission). I have no idea what the insurance company will say. Your best bet is to call them yourself. They could proably be more helpful to you. Anyway good luck.

This is just my input. I am from Texas. I was hit by someone not being on the insurance. I called the insurance company the car was under. It was the other persons fault and the father had given her consent to drive the car, the insurance paid for my car.

I filed a claim and am waiting to hear something today. I talked to the insurance adjuster yesterday afternoon and she said to call back this afternoon. My son had permission to drive even if it was just to the football field which was about a block away from where the accident happened and apparently the other boy had permission too bacause he had dropped his dad off at work. Would like to hear from anyone else who has been in my predicament.

NORMALLY, once the insurance company receives the claim, they will investigate and determine fault or percentage of liability.

The reason that I said normally, is that your situation is NOT normal. The fact that your son was unlicensed and driving with your permission, waives the requirement for the insurance company to pay!!

And since the other driver was also unlicensed, his will very probably refuse also.

Simply, both parties will be liable for their costs due to their allowing unlicensed drivers access to their vehicles. Now, how you 'divvy' up the liability will depend entirely on your ability to negotiate with the other party. The law will not allow you to benefit from an illegal act.

There are at least 17 lawsuits (!!) pending in various courts, including the US Supreme Court, asking if Obama is a natural born citizen (as req'd by Art II, Sec 1 of the US Constitution).

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!
