Underage DuiWhat is the name of your state? What is the name of your state? ARIZONA my son was charged with an underage dui last thanksgiving. He never pleaded guilty since we never had the paperwork stating the actual charges. after several continuances we recieved court papers stating that the charges were dropped.. now we hear that they refiled the charges against him after the charges were dismissed... can they do this? I was under the impression that after charges are dropped that they cant just keep coming for you... i sure hope that they cant... one more thing when this happened i came to work and was so relieved that my son had been given a second chance..anyway i told my boss who her husband is a SHERRIFF what happened, i am sure she went to her husband and told him what happened, now lo and behold her husband is at my doorstep to serve my son papers to refile charges... what do i do? |

| Yes, charges can be re-filed. In this case, at least the way it sounds, is if the police withdrew the charges (they weren't dismissed) for whatever reason. They have every right to re-file the charges. In Pa, we have a preliminary hearing to establish whether there is enoung probable cause to go to trial. If the Judge dismisses charges at this level due to insufficient PC, the police can re-file charges if they develop additional evidence (and therefore more PC). What you are thinking is when someone is acquitted or found not guilty. |
