Underage Dui/accident


What is the name of your state? PENNSYLVANIA

I am 18 years old. I left a party and should NOT have been driving. I wrecked into a tree and totaled the car. I had drank about 14 beers in 4 and a half hours so my BAC was probably pretty high at the time. I called my mom to come get me to take me to the hospital so i left the scene of the accident. I thought my injuries were more important than staying there. They took blood about 6 or 7 hours after i had drank my last beer. My lawyer said something about they have to take the blood test within 3 hours? the cop asked if i was drinking tonight and i said yes. He then asked if i was driving and i said yes. Will i be charged with a DUI? Is there any way at all to get out f it, and if so what should i say to fight the charges? What kind of penalties am i looking at besides an underage and possibly a DUI?

Most likely yes, at the very least. But I can't say for sure. The websites I see say within two hours, but you admitted to drinking and driving.

Likely not. You should seek the advice of your attorney. This is far too serious to get advice from an internet board from. Seek an attorney and you should enter some sort of drug/alcohol counseling immediately. No one, especially someone as young as you, should have a DUI. You need to deal with this now while you are young, because without treatment you will likely end up with another one. It honestly seems like you are more concerned with getting out of the charges than dealing with the root of the behavior.

Penalties, or charges? Leaving the scene of an accident comes to mind.

I havent drank since and i dont plan on it. If i do somehwere down the road then i know not to drink and drive. Yes i am concerned about getting out of the charges. I dont want them on my record. My lawyer said not to worry about the charges for leaving the scene of an accident. I never actually admitted to drinking and driving. I admitted to driving and drinking as two seperate things. He did not ask if i was driving drunk. Waht website are you looking at?

Uh, this website, and your post. Duh.

Out of curiosity, what did you blow those 6 or 7 hours later?

And if you're lawyer told you not to worry about the leaving the scene of an accident, he's lying. That will in all likelihood come up at some point.

I also find it highly strange that your mother would come and pick you up and bring you to the hospital rather than doing what any logical parent would do, which is tell you to call 911 or call herself if she thought you were injured. But that's just me.

As parents, we react sometimes rather than think clearly. It's also possible, just possible, that a cover-up was part of the plan. Fortunately, this poster found the hospital and was not seriously injured.

The issue is NOT the time from when you finished drinking to the blood test, but the time from which you were driving. I find it hard to believe that the hospital did not do any blood tests on a trauma victim for sevel hours.

You're in a heap of trouble. Shut up and listen to your lawyer.

Stop drinking before you kill yourself.

14 beers dude get some help before your drinking habits get worse no one should drink 14 beers.

as for the cop asking if you had been drinking.. you know you did not have to anwser him just because he is a cop you incrimated yourself to him and that is not going to help you.
