What is the name of your state? NY

I was arrested for DWI in NYC. A private lawyer appeared to me without request while in holding and I went with him as I really wanted to go home. Have you heard anything about this person, is it safe to proceed with him?

nydoll, really I think your question just boils down to making sure you do some research - how much is s/he going to cost? How experienced is s/he with DWIs? Is s/he reputable? Are they going to push you for an expensive trial or attempt to plead you down to a DWAI?

Did you already sign a retainer with your lawyer?

i don't know very much about what i'm doing here is the point. this guy shows up and i went with him, i wanted to go home. what should a look for? what should make me cautious? i've not signed a 'retainer', what is that, should i? would they purposely push me for a trial to make money? i can't afford this already. what questions should i ask?

Well, I'm definitely not a lawyer, just a guy who's in the exact same boat and has spent a good thirty hours reading up on this stuff. I can share some of my non-professional insight with you from what I've read and give you a head start, at least.

What's your situation? Is this a first time offense? What did you blow?

my strategy


I called all of the lawyers that sent me stuff to get an idea about what they are about and what they do. Make a spread sheet with all of their names, addresses, fees, and summary of phone call. a lot of them will chat for about 30 minutes - 1hour, depending. You can feel them out for about 10 hours, depending on how many you call, so at a cost of 300 per hour, you can get about 3,000 dollars worth of consultation, coaching, and 'hints' as to how to proceed. It might piss them off, so be polite and let them go if it sounds like they are busy.

Also, I compiled massive amounts of data from internet websites. I am planning on investing 100% of my trust into the Public Defender, and letting her/him know I am not a bad guy, someone that made an error in judgement, etc. I will show him/her, copies of pages from California Drunk Driving Law, as well as various defenses that I have formulated. I will plea 100% not guilty, and request video tape evidence, as I make time with the P.D. I will also make my own video tapes of the crime scene and other footage, to bring to the 1st arraignment, along with piles of papers and books.

what does any of this have to do with OJ? why do morons with nothing helpful to say lurk around on websites all day? i'm only glad i don't have to see or smell these people in person.
i'm really impressed by what you've learned and this encourages me to try and figure more about this stuff out too.
i'm now wondering, if i went with a lawyer, is it too late to ask for a public defendant?

If you haven's signed a retainer or anything with your lawyer, my NON-PROFESSIONAL understanding is that you're not tied to him. Keep in mind he could be perfectly fine, just make sure you're educated a little bit so that you know what you're getting into when he starts to talk about strategy or what he's aiming for.

Now - what's your situation? First time arrest? What'd you blow?

You can generally dump a lawyer at any time (retainer or not).

However before you take any advice from Mr.X_X_X you should read the thread he started about his DUI/hit and run and decide if he's the sort of guy you should be relying on for advice.
