What is a BAC?What is the name of your state? Missouri. What is a BAC? How does it differ from a DWI? I was charged with DWI, but pled guilty to th BAC, because I felt it was a lesser charge. Was I right? The penalties were not too stiff, and I understand that after 2 years it won't even appear on my record. Thanks...I know that BAC stand for blood alcohol content, but this was prosecuted as a completly different offense. My BAC was well above the legal limit for DWI, so I don't understand why it was changed. I'm glad it was, but I am still confused about it. Last edited by djh50; 03-26-2006 at 02:21 PM. it is the measurement used to determine if DWI or a lesser charge is appropriate. I don't understand what you may have plead guilty to. BAC is not a charge itself. (at least that I hae ever heard of) Some states have a lesser charge of impaired driving. If I remember correctly Michigan (where I live) uses .08 BAC as the DWI threshold and .02 BAC as the threshold for impaired driving. |

It looks as if this is the type of law that many DWI drivers argue for all the time. "I may have been drinking but I wasn't impaired". This takes it to the bottom line of a charge because of the BAC without regard to the possibilities of level of impairment. But the DWI charge doesn't require the chem test, just proof of impairment.
