What can I hope for w/ dui and accidentWhat is the name of your state?What is the name of your state? Michigan Case: I was driving home hit a parked semi parked in the road with no lights or anything on to make it visiable. I was a half block from my house the lights in my car went out for who knows what reason. This is my first offense with anything. No one was injured other then myself and my car. Cop said I would get a warrant in the mail still waiting on it. What is the best advice to help in this case??? If more information is needed please ask. |

BigMistakeFlWere you given breath test? Roadside sobriety tests? What makes you know this was DUI? Lights failed on your car and on the semi at the same time? Sounds like a scene from Close Encounters. |

| What makes me so sure is because of what the cop told my mom. They could not do a field test because I was being taken to the hospital. They did take my blood although I am not sure what they needed it for other then to check my levels. Just so you know the semi was parked and he did not have any lights on. My car on the other hand at one point did have lights and they went out. I am not really clear on most of the details but that could be from the head injury I did suffer from. Still confused in michigan please give me the best I can hope for. |

BigMistakeFlOne reason they draw blood in the ER is because they need to make ready in case you need a transfusion. Many arrests have been made subsequently based on the blood alcohol level determined by blood drawn in the ER. That is pretty much standard procedure. You might be able to argue that the semi with no lights in part caused the accident, but that might end up as a civil matter. It won't really have much effect on the DUI case against you. |
