What can really happen? What is the name of your state? Florida.
I really am dumbfounded and would like to know what could really happen legally, in the following situation:
One of the ladies in our office was convicted of a DUI approximately 4 & 1/2 months ago, (this is her second DUI, the last one being 15 years ago in another state). She had told her lawyer about it, but it never came up in court, so she was convicted as a 1st offense, got 6 months suspended license, classes, community service etc.
She went to the DMV to try and get a Hardship licence a few days ago. She was denied at the DMV Administrative hearing. We found out the reason yesterday that, while she was in the hearing, being recorded (and under oath, I think), she was asked if she had any prior DUI's, she said no. The woman in charge then said that she had some infomation concerning a prior DUI in the state which it did happen, and she told her that there must have been a mistake and that it must be someone else with the same name because it wasn't her.
Then she admitted to us, that when she went downtown a few months ago to turn in her lifetime driving history, she gave them every state that she lived in except the one with the DUI and that she both told the clerk, and signed a statement saying that she did not have any prior DUI's anywhere.
I personally thought, that they might not give her back her licence after the 6 months is finished, or she could be charged with purgery. What do you think???
Thank you
