what could happen


California . First off I was wondering if any one knows the bac point scale system and what the different types of convictions are associated with those points?
Next i was wonder what actions could be taken on a friend of mine.
He is an of age sailor who was drinking some beers in a us territory with some friends they were all one or two ranks higher than him and after a while one of his friends was beyond drunk and needed to get back to the boat his other friends wanted to contiue drinking and ordered my friend to take the guy back to the boat knowing that my friend was drinking as well. So he drove back to the boat and helped his friend to the quarterdeck. they both where ordred to take a breathalizer and my friend the one who was driving blew a 0.02. He was in no way disorderly and was not stopped at his car what actions if any do you think may be taken?What is the name of your state?

Every state has their own rules, but .02 is pretty much at the threshold of accuracy for most units so it's a fightable charge.

This however sounds like a military issue of which I am not familiar.

Since this is not a state crime issue, the issue of BAC and penalties for California is irrelevent. This would seem to be a personnel matter and not a legal one.

This is a military matter and not a matter for any state. If Navy personnel made him blow back on the ship, then this is not a civilian court matter.

This will be entirely up to your commanding officer. If the ship was on active status then there is a good possibility that a "no drinking" ban was in affect in which case he could be punished by the commander.

Sounds like you have a kinda like sorta maybe idea of what maybe is what is the thing is? so why don't ya give it to us and let us work on it then. Or maybe we may be up nights with Abe and the Beaver and the scuba-diver thingking about it? Huh?

ahhh,,,,yeah. I double the "What"?

I think it's a military issue. My husband is in the Navy and sometimes they have no drinking times. This may have been one of them. It more than likely will be left up to the commanding officer.
