Question

What is the real deal?


What is the name of your state? GA - Fulton Co. Atlanta

Last weekend I made a big mistake and drove three miles from the bar to my friend's house. I 'layed a wheel' as I turned left half way there. An off-duty policeman saw this, and then followed me for a mile to a stop light, where he got out and asked for my drivers license and insurance. I gave it to him. He called or radioed another officer. They sat behind me and spoke for what seemed like 15 minutes. Then the on-duty officer asked me to get out and do the eye, one leg, alco sensor, and straight line tests. I, as well as my friend thought I did well. The officer did not demonstrate any of the tests. I informed him that I was wearing backless clog shoes. Also, the ground was unlevel. He ignored that. He handcuffed me and took me in. I blew a .145 on the AlcoSensor 5000.

I got 4 tickets. DUI, Reckless driving, Laying drags, and Failure to maintain lane. The on-duty officer's name was on all tickets, but the off-duty officer's name was only on the Laying drags and Failure to maintain lane. How can he say I was wreckless driving when he did not see me drive?

Is all of the above legal? Can an off-duty officer do what he did?


The real question is what to do. This is my first offense, and for that matter my first arrest period. I am 29. I was going to plead guilty until I saw how harsh the penalties are.

The top Atlanta lawyer wants a flat fee of $6,000. He said he has a 85% success rate. He said that I would pay that in insurance alone, and that most people who do not fight a DUI wish they did later.

My frinds have all told me that it is all about money. You pay a huge amount for the best lawyer. He will have the case dismissed or plea bargain for a lesser charge, or if it goes to trial there is a very good chance of being found not guilty. Is this true? What are the actual percentages?

Can the AlcoSensor 5000 results really be questioned?

What are the other arguments? Do I have a case?

Should I pay that much for a lawyer?

**A: the real deal is that you are guilty so start talking to other lawyers if you are not going to hire the top dog.
