Will I go to jail 1st offense .16?


What is the name of your state? CA
I first did a post back in Aug. this year, with "Will I go to jail 1st offense .16?" Well, had a visti to my lawyer yesterday, and here is the good news. I blew a .16 then .15 at the CHP in San Diego. Spent at leat 10 hours in jail that night. The lawyer and prosecutor came up with this. 2 points on my driving record, NO JAIL, 5 yrs. probate, $1,800.00 fine, 3 months DUI class (which I'm in my 2nd month already) maybe 1-3 days public servicem and no license disruption, suspension, nothing. All papers are signed except for the public service, depending on what the prosecutor and laywer work out. Laywer says, he thinks I won't get any.. But won't know until another week. They also dropped 1 count "I can't remember what it was" but I'm pledding guilty to driving with a .08 or higher. In another 2 weeks my lawyer goes back to another court for when I pulled over while my license was suspended. He's shooting for driving with an expired license. $150.00 and I'm done. The driving on suspend, carries 96 hrs. manadatory jail time, but the lawyers' pretty good in keeping me out.....What is the name of your state?

That's all good for you. So, you gonna adhere to any driving restrictions? And stay away from the bars?

One common DUI restriction is not to drive with any alcohol in your system and to avoid frequenting establishments where alcohol is the primary item sold ... so, no liquor stores or bars and no drinking anywhere near the time you drive.

Hopefully you have learned not to drink and drive. Far too frequently we arrest drivers on repeat offenses.

Mike, check with DMV about your license. Be careful - the Court has nothing to do with DMV (and DMV is suspending the licenses, not the Court); also check with DMV about any other requirements of DMV... such as additional insurance you may have to pay for & if a reissue fee is required.

PS: there's no mandatory 98 hrs in jail on driving w/susp lic.
for 14601.1(a) there's no required jail time; for 14601.2, there's a mandatory 10 days in jail.

Maybe your atty can get it reduced to a 12500 with a 150 fine, if so - he did a very good job.
