wrongfully charged with DUI; please help


What is the name of your state? California
Here is what happened; last month my boyfriend was stop, searched, arrested and charged with DUI, the police insisted the "white powder" in his nose was cocaine when indeed was medicine he uses for acne he told them this but they still cuff him and took him to jail, He was so scared he started to have shortness of breath and chest pains, so he was taken to the emergency room where they run many tests including a toxicology screen which showed no traces of alcohol or any other drug, still we have to go to court tomorrow and just need some advice on how to explain this situation, sadly we can't afford an attorney,

First, if he cannot afford one, an attorney will be appointed for him by the court at his arraignment.

Second, what "acne medicine" is ingested in the nose and is a white powder?

Third, how do you know what the tox screen at the hospital read?

If there is no proof of the DUI then the charges will ultimately be dropped. If the tx comes back negative, then that will likely tell the tale.

I agree that the tox test will prove your husband's innocence. Unless the cop has some very strong evidence as to weaving all over the road with a film of it, you should not worry too much.

Be sure about that tox test.

Thank you guys; well the acne medicine is call proactive and I went to the hospital and obtained his medical records which included the tox report,

I use Pro-Activ and you never put that up your nose! Its a lotion, and has 3 steps that are liquid. Sorry but your bf is lying to you! Hate to break that to you!

Did the tox report list ethanol as well? That could be the root of the DUI charges. The "white powder" could have easily been a misunderstanding on the officer's part.
