School Dept Lost Private Information

What is the name of your state (only U.S. law)? TN

My daughters school informed me that they do not have a copy of
her birth certificate, social security card and her immunization sheet.

Apparently when she transfered from elementary school to middle school
this year, they were not in her records.

Im currently speaking with both principals of both schools about this.
Middle school claims they were never sent with the records. Elementary school claims they were all there.
Middle school seems pretty adament they were not in there and even had me
look through my daughters file. And they were not in there.
The elementary school has screwed up forms before on me so I figure it is on their end.
Either way, the school dept has lost private information and Im pretty ticked!!

What resources do I have?

Send copies to the school for their records.

sometimes paperwork gets lost.

Resources for what?

If you don't have a copy of the immunization record, call her pediatrician.
If you don't have the Social Security Card go here http://www.ssa.gov/ssnumber/
If you don't have the birth certificate, go to the vital records department where she was born.

If you're just upset that they have misplaced the copies THE SCHOOL keeps.
Get over it. There's no action that you you can (or even apparently needs) to be taken.

HIPPA has nothing to do with this.

I can understand you being ticked. But you don't know if this is an accident, and I'm pretty sure it's not criminal. If you are worried about identity theft, check into one of these services.

Yes. Get over it and get new copies for the school.

Not the private data you seem to think it protects.

Yes, I have heard of HIPAA laws. What's more, I know what they mean and what they cover. Something that apparently you don't, if you think they apply here.

And it's HIPAA, not HIPA.

What possibily recourse do you think you would have against the school for losing paperwork? Unless your child's identity has been stolen and you can prove it was because the school lost this paperwork then you have no recourse. You have not won the lawsuit lottery.

Yep, and the school is not a covered entity under HIPAA.
You may wish to look at FERPA.

However, lost doesn't mean disclosed, so you're getting worked up over very little.
