Drug abuse and incompetence


What is the name of your state (only U.S. law)? North Carolina

My 80 yo mother is severely addicted to prescription drugs. Ambien, Soma, Percoset, Darvocet and Valium to name a few, that one of her docs have her on. She suffered a stroke in July and its believed to be a direct result of the overuse of these medications. I have since taken all meds from her home and dispense them to her personally but she continues to get these meds from a doc that refused to believe she is abusing them and she has someone drive her to the drug store to get them. The last time she took 2 ambien on the way home from the drug store and couldnt stiffen her legs enough to help get herself into the wheelchair because she was so high.
To complicate everything, about 3 years ago she took in a homeless man who we have since learned has a drug history himself (selling, manufacturing) and who we have witnessed selling his own percoset in my mothers yard to one of his family members. She refuses to make him leave, insisting he does EVERYTHING for her and she has now given him POA and added him to her bank accounts. He is of course her enabler and it is our belief that he will continue to allow her to abuse these medications and will eventually end up allowing her to kill herself.
I guess my question would be ... is her drug abuse enough to deem her incompetent, allowing us to oversee her health and her well being and removing this other person from her home?
I see this as the only course of action as she fully believes HE is the only one who will see to her care. Of course, we, her children know that it is because she knows he will keep her in the drugs she so badly wants.

Somone..... Please HELP!
