Gotta get mother from Chicago


What is the name of your state (only U.S. law)? Arkansas

I am the only child of my mother who lives in Chicago Illinois, and is in a nursing home there. My wife and I have decided to move her to Arkansas to live with us. What are the steps that we need to take in order to legally remove her from the nursing home, and to move her in with us. She is mentally and physically capacitated, and is currently a ward of the state of Illinois. Please Help!!!

This is not a legal response in anyway.....but...

What makes you think that you will be able to care for your mother in a professional way on a 24x7 basis?

I ask this, only because we had my MIL move in with us for a period of time when it became evident that she could not live by herself anymore. While living with us she further mentally and physically deteriorated to the point that it became very evident to us, that we were not qualified to handle her care any longer. She is now in a nursing home, and although a very hard decision to make at the time, is now clear to us that it is exactly the correct decision. They have on site nursing and doctor care, on site physical therapy, on site activities, etc. They provide a level of care and service which is an order of magnitude greater (and far superior) than we could ever hope to achieve if we were doing it ourselves. We had even set up a downstairs bedroom, and handicapped accessible bath, with her own space if she wanted. Even with everything setup correctly, it's impossible to provide 24x7 on-demand coverage as needed, even when we brought in additional outside assistance.

I'd suggest really trying to think through the practicality of what you intending to do, and then what happens if you determine you can't handle her needs anymore and have to move her back.
