my mother was in a nursing home in the process of applying for title 19...she had been assigned a client # but the paperwork had not been completed when she passed away....we had reduced her assets down to below the required dollar amount and redirected her pension & social security to the nursing home, but everything was still pending.....my question is this...since her estate is practically nothing, do we need to continue with the process of filling out the title 19 information ? or should the little of her estate that is left be used to payoff the balance of whatever bills she might have? supposedly the title 19 would be retroactive to when her medicare and private insurance no longer covered her stay at the nursing home thanks

Ask the Social Service person who was handling your mother's account for guidance.

Was the reduction of assets done in the manner you were advised such as glasses, wheel chair, teeth etc.? In other words you did not start giving children money and assets in anticipation of the Medicaid assistance? That would be the only complication but since the pension and ss checks were given to the Nursing Home it does not seem as if you were trying to deceive.

Just ask the person the family was working with at the Nursing home and they should be able to answer your questions.
