1) We bought a manufactured home 4-20-04, in Grand Junction, CO. It was to be ready by 6-15-04. 2)The house was ready on 5-13-04. Financing was not. House sat at manufacturer's in Idaho. 3) Finally had to finance construction loan through contractor in Denver area. Our 10 acre property was used as collateral on his loan. 4) House was delivered to property on 7-10-04. No foundation was finished. Company we bought home from was supposed to come and inspect house which they did, but they did not inspect the roof. 5) Contractor did not inspect the roof. 6) 7-24-04 - ceiling collapse in eating area. Contractor notified. 7) Ceiling collapses in master bedroom, master bathroom, and more in eating area by next weekend. Contractor notified (we were still living in GR at this time - only out on occasional weekends). 8) Around 8-21-04, took family to property. Fire alarms going off (shorting out because of wetness), mold growing on floors, walls, ceilings. Nothing cleaned up from collapse. Contacted contractor. 9) 8-29-04 Contractor brings in mold expert after he puts house on foundation and brings it together. Mold expert thinks it can be repaired. Contractor wants to do it himself with mold expert advice. 10) By 10-22-04 we called in air quality expert. Mold in home at high levels. In addition, we find wet insulation pockets in crawl space of home. 11) Contractor finally brings in his insurance company around this time. 12) Insurance company says they are not responsible. Manufacturer says it is not responsible. People we bought from say they are not responsible. 13)Try mediation 14) Try for conference with lawyers of all parties (contractors lawyer does not participate) 15) Agree to set court date on 5-26-05. Contractor's, manufacturer's, seller's lawyers not available to set date (though the 5-26 date was set two weeks previous). All are asking for us to pay their legal fees. Still no court date set. We are now living with family members. (since 12-31-04). Need to get rid of house and start over without having a $180,000 loan - the bank is threatening to foreclose ( we would lose all of our money and our credit would be kerplunk)
