Raw Sewage

What is the name of your state (only U.S. law)? Arizona

I live in a community of 4 plex apartments, each building owned by separate entities. One of the buildings has raw sewage pooling on the side of the building. The building at the moment is empty, all 4 tenants have moved out. The property is being readied to rent again.

This raw sewage is a health hazard, has been reported to the health dept and fines are being generated against the owner. Everyone has to breath the stench, the children play in the area, there is not even a fence around the pooling to keep the children away. This has been ongoing for 3 months.

What type of an attorney is needed to sue the owners? There would be more than one family involved.

Start with your city /county building inspections desk , ANY work orders they have written to the property do not just vanish, the work orders will have to be done, the information is public and you can review them by going there and learning what the orders are and if the work orders include repairs to the sewer. Instead of attempting to sue the owner you can be a pain in the owners side by learning what work orders have been issued and then paying attention, If a work order stated that the sewer line must be repaired by a licensed plumber and your city /county also requires a permit to be filed for the repair and you see some one digging up and repairing the line but do not see a visible posted in public view permit over there then call your city inspections and report that the work is being done with out permit so they can send someone out and stop the work. As far as any sewage pool there will your county health dept will they order the city to send a water tank truck out there to dilute the sewage ? BTW as far as children playing outside , personally I think this is a parental problem re obediance if the children will not stay away or play elsewhere on the property. If you want to be a pain in the side do it by learning EVERY thing you can about your city /county /state laws and ords and stay focused on inspections doing its job including reporting to it ANY and all violations of work orders that you read for that address.

been through the city, county, state, building, health and environmental agencies, the most we get is the owner keeps racking up fines. The news crew contacted the owner, and the property is in receivorship. In other words, too bad, so sad, cant even get it cleaned up and fixed, much less sue. The bank will do nothing except try to unload the property, and then its the new owners responsibility.
