I live in Arizona, my husband is retired and
we have stocks and a retirement plan.We have been married for 39 yrs.
I have never worked except for a couple of partime jobs during our marriage.
I'm 55 and he is 60.
He is an alcoholic and I'm thinking of divorce.
My question is when I file can he be made to move out of our home and to make payments on the home and take care of me until the divorce is settled and the monies are divided. I'm also have some very serious health problems. Thank you

My response:

You live in a Community Property State. All assets, including the home, will be sold or cashed out, and split equally.

You will receive spousal support, in an amount and duration set by guidelines in Arizona, or by agreement between the two of you, or decided by a judge if you cannot agree.

He must, by law, support you until such time as the dissolution is final. This support is called "Pendant Lite" support.

Start looking for a job and new digs.
