Question

my daughter's father got married when she was 6years old. He married into a well off family and spent time going in and out of jail. They had a daughter who is 13. His wife just died. During the time she was sick he was living with his girlfriend and 2 sons
he took care of them but he was slow in paying his child support but during this time he has accumulated a 1999 Mercedes and a 1998 Jeep all of this while supposedly working in a shop as a car detailer making $150 a week. Now that the wife has died he is getting the home cleaned so that he and the daughter and the girlfriend and her children can move in. But he is 2 months behind in his child support and we are due back in court on Oct.4. He is going to collect on insurance and other proceeds. Is there a way the court can make him pay his back child support of over $10,000. My daughter will be finishing high school in January and he says that since she has a trust fund from me suing the School District he shouldn't have to take care of her.

My response:

He is so full of S H I T ! See an attorney first thing tomorrow, and get him into court tomorrow on an emergency Motion for a hearing on an Order to Show Cause Re: Contempt of Court for the arrearages and other failures to follow the court's orders. Watch him get carted off to jail (again) for having breached the court's orders of support. Boy, how some men can bamboozle women . . . it's just amazing!!

I don't care if you have ONE MILLION DOLLARS in a trust fund for her. That money is not support, nor does it invalidate the current court orders. The orders are the orders, and until otherwise changed by the court, those are the orders. GO GET HIM !!

IAAL.
