| My question is this, my ex-wife filed bk by herself without my knowledge while we were going through a divorce, it was done tho while we were still married. Would she of had to of had my signature on this bk also? My credit report doesn;'t show any bk but bills are gone. I just want to know if this was legal or not? Thani you |

If you had any joint, marital, debts, like bank loans, or credit card bills, you can be assured that the creditors will catch up with you for payment (unless you file BK also). It must be my fault, because I Am Always Liable. Anyway, I did say that she can file BK "separately" from you, which means she would not have needed your signature to file for BK. All marital debts are "joint and several", the word "several" being a key word. She can pay debts "severed" from you, or she can discharge her debts "severed" from you. Or, she and you can "jointly" pay debts together, or you can both "jointly" discharge debts in BK, or you can pay debts "severed" from her, or you can discharge your debts "severed" from her (if you wanted to file for BK, for example).
