My daughters father is behind over $4000 in child support. everytime i go down to friend of the court it seems like they just don't care that he is that far behind. He started at paying $56 a week and now he is supposed to pay $60 a week but he is not paying and i am not sure what to do anymore. i am thinking about denying visitation until he starts paying. i was supposed to get his income tax return but the state of michigan screwed up and sent it to him and he spent it on himself instead of sending it in for child support. please help if you can. i am to the point of hiring an attorney to get this situation taken care of.

I understand your frustration, but you legally cannot withhold visitation because your ex isn't paying support. Support and visitation are considered two separate issues in the eyes of the law. If you withhold visitation, YOU may be found in contempt of court. I'm sure you don't want that.
I doubt that you will be able to rectify this situation by yourself. You NEED an attorney. Good Luck!

I feel for you - I too live in Michigan and am having trouble with Friend of The Court. They haven't even STARTED my support. My daughter's father has been ordered to pay me almost $800 a month (including back support from Jan.) and I haven't rec'd a dime yet. I have no idea even WHO to contact at FOC because I have never talked to them so have no idea who my case worker or whatever is. I am dealing with an out of state support issue so that may be the reason for delay, but the whole situation has been aweful from the get go. I don't understand why this state's FOC finds it so hard to get cases STARTED, but they are right on the ball when someone gets a new job. I work in Human Resources and our new employees are usually getting their money withheld from the FIRST paycheck!! Gotta love Michigan!!!!!!
