sorry for all the new posts, i take it i am supposed to use the reply button on the same post if i have something else to say. =( sorry! I know we are expecting the worst. because the mother wants us to have no visits even after all we have initiated. she is unreasonable and will fight us for the minimum. that is why we are forseeing the worst so we are prepared for all she will throw at us. she plays dirty and wants us to get nothing. chance of us getting name change? we pay support-had to fight her so we could pay support too.duh. she wants him to have nothing. and what she will give is on her stipulations. my other questionis about the papers will say he is responsible for transportatioin for visitation. we were told it dosent mean he personally has to get the child and no one else can. it just means he has to set up some kind of transportation. what if (and i know by her past actions and comments this will happen) i go to pick up my step daughter because my husband is working or cant make it to pick her up personally and she wont let me take her? or says i am not allowed on her property? does she have to let the child go with me? our attorney says he is responsible for setting up transportation not getting her personally-he could send a cab. What if she wont let me get her? does she have to let me? Also, what is common procedure in a court room for this? How far can she push the date out by getting a continuance? i know this is alot of questions but i really need help and our attorney is not very helpful. i need advice, we have no where else to turn and you all have helped. please take time to answer each of these questions. we need help!!thank you soooo much.jamie t ohio. does anyone know what standard basic minimum visitaion is in ohio?

Unless a judge writes into the order that you can pick up the baby, then she only has to release the child to the father and no one else. For a baby, I think this is spot on. I am not sure what you meant about sending a cab, how will the baby pay for it ?

our attorney told us that as long as the father pays for or sets up the transportation and the mother doesnt have to lift a finger he is responsible for the transp. it dosent mean he personally has to get her. as long as he makes the arrangments. why would our attorney tell us that? and the papers dont actually say he has to come it just says he is to be responsible for it. setting it up so mom does not. what about my other questions in my initial post, i really need some answers. We are confused. Our attorney doesnt help, this is all i have for help.

One further thing.. and this is meant to help you, not judge.. if you come across to SS, the judge or any other state appointed official the way you have done on this board, you may seriously effect your husbands case. It is not YOUR baby and you have no legal standing. All the 'work' petitions etc has to be done by your husband, in court, you sit behind him and say nothing unless asked by the judge. Sometimes, a judge can see an overbearing step parent and actual deny or reduce an order for the bio parent.

Something to think about..

Unless otherwise stated in the court order, if you turn up at her door and she refuses to release the baby into your care then there is little you can do about it. Yes, you can petition the court but on what ? she is not denying him visitation, he has every right to go get the baby himself.

When you go back to court, a judge *may* amend the order to allow you to pick up the baby, but until then she does not have to pass the baby into your care at all.

Remember, the court order is between the mother and father.. it is unlikely it will mention you.

i know it will not involve me but why did our attorney tell us that? If it is the fathers visitation time they say he can send whoever to pick up the baby and it isnt her choice. why did they tell us that??? What if he has to work? What about name change if he pays support? He is petitioning the court to do so and the mother does not want the baby to have his name. our attornay says well get it, what do you think? We are going in fighting her for the minimum. It dosent make sense she wont give us any without her stipulations all over everything. Seeing my hubby initiated everything wont the judge see she is totally unreasonable? What is minimum visitation in Ohio? Seems like we have to work so hard just for the minimum! They are total strangers and she can t say anything against him. At one time when they were together she said she couldnt find a better father. The only reason she isnt giving is because she is mad he isnt with her. How can we get the judge to listen to our side and let him see all weve done, plus tried to negotiate with her for the bare min and she wouldnt allow it. Will we get a chance to tell him? How does this work in court?

i am not trying to be overbearing but this girl has tried to manipulate my husband and try to trick him into thinking he has to listen to her and take less. I am just helping out, of course i wont say a word in court unless asked. My husband works alot and I am just digging info all day, since he cant. Not trying to take over, just trying to make sure she isnt tricking him and making things unfair. We just have alot of questions it seems like no one can answer.

Name Change, overnight visitation.. depends on the judge. He may order it, he may not. All you can do is present your case.

As for pickup, as I said, if she say no to you, then tough.
