| I spoke with a person on a Domestic Violence hotline and was told that I may be able to have ex-boyfriend temporarily removed from our apartment. I would have to file for an, " Exclusionary Order of Protection." But I haven't seen a counselor at the Queens (NY) County courthouse yet, so I don't know if he would still be liable to pay household bills while he is not here. It would just be until I have our baby, which is due late November. The stress of the constant fighting is just too much for me and my unborn child, as well as my two year old. Does anyone know anything about this and if so, does he still have to support the household? Holding my breath... Cari/NYC |

Cari/NYC[/b]

My response: Why are you going to "other sites" when you know that FreeAdvice.Com is the best place to be and ask your questions? They are called all sorts of differing names all over the country, but Restraining Orders, no matter the name, do the same thing. You can do this yourself. Go to your criminal courts building, see the Filing Clerk at the window, and ask for the papers to apply for a Temporary Restraining Order. Fill them out and be EXTREMELY GRAPHIC with your words - - no holds barred. Mention what he did to you, when he did it, how many times he did it, and how it affected you on every occasion. Give the papers back to the clerk at the window (there may be a small filing fee) and the Clerk will tell you which courtroom to go to. The judge will read your papers, ask you a few questions, and GRANT your orders. Then the judge will tell you when the next hearing is to take place, to have all the parties present, and whether or not the Temporary Orders are to become PERMANENT. Then, give the Temporary Orders to the Sheriff, or other proper law enforcement agent at the courthouse, pay a service of process fee, and have the papers served on your "jerk" and OUT HE GOES, RIGHT NOW, and with only the clothes he's wearing. That's it, no time for gathering anything - - he's out right now. Do it tomorrow and stop being a punching bag. You're a woman, damn it!!
