| I have been told that it is not advisable for one spouse to move out of the family home in cases that involve custody until a motion has been filed. I am planning to tell my wife that I want a divorce. Once done, I would like to move out as quickly as possible. Should I wait until I have retained a lawyer and started the legal wheels in motion? I plan to seek joint custody the kids. |

| I'm not real sure about the "legal" aspects of this..but I do know that if you move out and nothing is filed then she could say that you "abandoned" her and the children and that could be used against you. If you want to leave, I suggest you and your wife sit down and work out an agreement regarding the kids and everything, sign it and file it with the courts. If that can't be done, then I would suggest gettting an attorney asap..eliminating the possibility of you looking like *you* deserted the family. Also, if you pay her support while you are in the process of divorce, document everything to prove that you have continued your "support" for the kids. Good luck! ![]() |
