My ex, after 2 months of our separation, has brought inside the house to a man that smokes around my 3 kids, one 3, one 2 and one 1 years old. I had problems with this guys since the beggining, he believes that he is the new father and that I have to go through him to see my children. Yesterday, she brought my kids and when i go out the get them out of the car, him and his friend were smoking inside the car with my 3 kids, needless to say that I had to get him out of the car and he told me that he did not care, well after It got me in rage and I threw him on the sidewalk. I can not do this every day and I dont want to get in trouble and go to jail and then I will not see my children. Can I put an injuntion order against this guy.
Please Help me

My response:

File a Restraining Order against him. Go get a "How To" book at your local bookstore.

My response:

So?

No matter what he does, from a legal standpoint, he's going to have to contend with that fact. At any type of hearing, he may have to answer to a charge of assault and battery. That's not my issue.

My issue was the safety of the child, and for that, I agree with our writer. In that regard, he can file a Restraining Order. Now, that doesn't mean that the boyfriend can't file a criminal complaint against our writer. Nor does it mean that the boyfriend can't file a Civil Complaint for Assault and Battery against our writer.

But, again, that's not my issue, nor the reason why our writer wrote in the first place.

So, yes, I read it, and for the above reasons, I ignored it because that fact has nothing to do with the safety of the child.

Well, yes I admit that I made a mistake, I told him that I dont want him giving dicipline to my kids, my ex told me That he will do that i he(new guy) see that he has to.
Again, i made a mistake, but when you believe that your children are in danger, especially when he had a case of domestic violence.
