I am not getting a divorce, however my husband and I have found ourselves in the middle of an ugly custody battle. We are providing a home for my girlfriend and her 2 children. Now that she and her dhildren are staying with us her ex feels this is the time to fight her for custody. He is claiming that our home is bad for the children. He has requested an emergency injunction claiming everything from sexual deviant behavior of myself, my husband and his wife, I'm abusive to my 15 year old daughter, My husband is abusive to me and most importantly we are alcoholics. Can I do anything? Please help, I'm going to see a lawyer tomorrow. I am in California.

Good.. that is the advice that would have been given.. please let us know what they say.

Attorney said that because it is in legal pleadings ie witness, lawyer, plaintif etc. I have no case. In addition I would have to prove damages. The only thing I can do is rebut the statement in a declaration to the court as part of the moms answer to the request for injunction.

The attorney gave good advice.. gather your evidence, document everything and shoot her down in court so she crashes to the ground in a blazing ball fuelled by the explosive smell and dripping sweat of her fear ..
