Question

When a custody change occurs and yet it was done so unfairly, is it etched in stone or can you file something like an appeal? Today, my sister lost her children to 12 hours a month of monitored visitations from shared custody to every other weekend to this. This is absolutely devistating. The judge didn't look at the case fairly and only allowed herself to view the father's declarations and outright refused to review the mothers. The judge was only brought into this case recently (previous judge retired), appeared twice only and didn't bother to look at the 8 year history of the case to make such a drastic determination. Within the state of California, do the children have a right to be heard (ages 14 and 11)? They are now in the hands of a verbally abusive father who continues to take out it his anger of his ex-wife on them.

this is a risk step but she can file emergancy change of custody(look at my last post to mom in tx)she can state the fear of "abusive" father and ask for a child avocate to look into and talk to kids the child avocate realy have more say than anyone with the judge. If she wins husband can be ordered to pay her lawyer.I hope she has a lawyer or gets a new one. In Ind 14 a childs wants are heavy BUT look into child avocate they talk FOR children in court.Hope this helps sounds like he is a male version of my husband ex.
