Question

what are the effects of bankruptcy on child support payments and their amounts?
if the debtor is given total liquidation can i go back afterwards and get a remodification of the payments since he is making 45,000/yr?

my understanding from bankruptcy is that not everything can be written off. for example taxes etc. i believe, but check with an attorney, and it may depend on your state, but from what i have heard and experienced, child support cannot be bk'd upon.

Just because he may file for bankruptcy does not mean you will get more child support. If he's filing bankruptcy he must not be able to meet his bills and is looking to start over. Why would you want this starting over period to begin by raising child support? Are you not getting enough? Also, you can not just go in anytime you want to asked for a modification in child support. There are requirements thatmust be met. I don't know your circumstances, but if you are receiving enough money and paying a good amount yourself...leave it alone.

to red, you assume that i am attempting to get more when what i am doing is attempting to preserve what little my children get.
he has always attempted to get out of paying from school pictures to braces. he had a take home pay of 37K. now last time i checked, child support payments should not force one to rack up 40k in credit card bills! i know what type of cars he drives and the home he lives in, no excuses.

Liza, you did not indicate whether or not you work and what financial responsibility you're taking for your children.

My ex also assumes that I have to pay for each incidental expense when I pay a lot of child support ($1000/month for two children) and also take a lot or responsibilty for them.

Her pleas for more money always suggest that she thinks she has no financial responsibilties for the children.

My large child support payments mean that my wife (I remarried) and her children have to do without some things -- even though she makes $85K a year -- marriage penalties on taxes really get us.

I was just wondering, Liza. About the braces part, did the courts make him pay for them or half of them? Or what happened with that situation?
