| My spouse and I have been living apart for 3 months and now wife is having an intimate relationship with another man. Is that considered adultery and where do I stand? There have been no legal or otherwise documents signed or filed by either one of us. The only thing that was signed was an agreement for visitation and support of our children, which was notarized by not legallyy filed. Now I want full custody of my children, where would I stand in that respect. I do not want them subjected to anything that she and her other might do together while they are present. | When you file for divorce, or before, you can petition the courts for custody. In most states the only way the court will not allow the mother to have physcial custody is for proof that the children would be in a harmfull enviroment with her. Hard to prove. But, you could get joint physical custody, where you have equal amount of time and resposibility. In this case, most likely no child support would change hands. There is also the chance if you had joint custody, the mother may decide that she likes the freedom with her new fellow and after awhile give you full custody. Try for full custody and at least settle for joint. Good luck and God bless. |
