THIS IS FOR MY BROTHER WHO LIVES IN ALABAMA.HIS SON WANTS TO LIVE WITH HIM, BUT MOM SAYS NO. SHE HAS BEEN KICKED OUT OF THE HOUSE. THEY WERE LIVING IN AND NOW LIVING FROM MOTEL TO MOTEL.THE BOY IS 16 YEARS OLD HOW CAN HE GET CUSTODY OF HIS SON.HE HAS HAD HIM FOR THE SUMMER NOW ITS TIME TO GO HOME, THIS WEEK.THEY WERE DIVORCED IN FLORIDA. THANKS FOR ANY ADVICE I CAN GET.

In order for your brother to pursue custody he will have to file for custody..have him file on the grounds that she is not supplying him with a stable environment..She is absolutely not. Poor kid, no wonder he wants to live with Dad. He will have to fight tho..at 16 a judge will most likely hear his side and his feelings..since it's not a matter of..my dad has better rules, or my dad lets me do more..It's a matter of this child needs a home...He has a good chance..Good luck to your brother!
