Unhappy

my daughter-in-law has a son by her first
marriage, he is 9 yrs. and very unhappy, his
father has re-married and has full custody of
the boy.At the custody hearing he was friends
with the good old guys in that small community including the officials, so need-
less to say he got full custody.Isn't this
a conflict of interest??
The Mother pays child support, which is no where what the father would have had to pay,
she feels the father wanted full custody for
he would have had to pay much more than her.
He now has another child with the new wife,
but the boy seems to be very unhappy. He is 9 yrs.
old and weighs approx. 150lbs. he cries all
the way back home after visitation,he says he
doesn't want to go back.What in Ohio is the
age a child may make a descion to live with
the parent he chooses ??
I am inquiring in this forum hoping someone
has had this problem.

A 9 year old could be asked to talk directly with the judge in chambers.. but it is rare. All she can do is petition the court for a change in custody .. but something major would have had to have changed between the last order and today..

What she should have done was appeal the original decision immediately.

In the state of Ohio what age does the child
have to be to choose which parent he wishes
to live with???

I think she means when will the judge hear what the child has to say. It would help her to know anyway.

She asked at what age the child has to be to decide.. that is 18 ... at what age does the childs opinion count ? that depends on the judge but generally never under 12, and normally above 14.
