I was married in 1981 in South Carolina and divorced in South Carolina in 1990. There was one child from this marriage. My ex-husband's parental rights were terminated by the court in our divorce agreement. I was given sole custody of my son. No child support guidelines were given in the divoce agreement. I have never pursued child support and my son is now 16 years old. My son has recently begun a relationship with his father and his father's family. He has moved to live with his aunt (his father's sister) in the state of Virginia. I have been supporting my son (on my own - without a court order) since he left. However, my ex-husband has not and I feel that the aunt is putting a lot of pressure on me to give more than I am giving even though her brother is contributing nothing. What can I do? Can I pursue back support and use the money I receive to give more to the aunt?

this is no doubt a long story, as to why your son is now living with your ex's sister. Regarding if you can be awarded support for the duration of time that his father's rights were terminated, No, the court cannot do that. However, I am not sure if you can have some form of parental rights re-established, because your son is in deed back in touch with his father & father's family, and I hope there is a way for that to be re-established, b/c it is his responsibility also to support your son.
