| Wisconsin. An 18 year old girl recently moved out of her fathers house into her own apartment, she is still in high school and has a full time job. During that time she was receiving child support from her mother. The mother is still paying child support, but the father refuses to give the checks to his daughter because "he needs the money". Now that she is 18 years old, the mother still has to pay child support until she finishes school, but, since she is no longer living at home with her father will he also have to pay child support until she finishes school? |

| I believe most times, when a child is living on their own outside the custodial parent's home before the age of 18, supporting themselves, I believe that the child becomes an emancipated minor. I am not sure if you must prove this in court before it is legal to stop paying child support, but it's worth looking into. Just go to your local family court, and ask. The clerks usually know the facts of what's true, and can tell you how to go about it, without a lawyer. Good luck! |
