My ex has to pay me every friday in the divorce agreement. He gets paid bi-weekly so he pays me bi-weekly.The problem is he drops the check off at my parents house. My mother is very ill with cancer and does not want him there but my dad refuses to say anything. He never drops the check off at the same time so I have to wait (I now some people don't get anything) Most the time its after the banks close, My account is with a credit union so they are not open on a weekend(I like my bank and don't want to switch) My problem is I am moving about 35 miles from my parents and will not be able to get the check any way. Is there a way I can get him garnished? or at least have him get the money to me?

My response:

If you want to spend the money, you can take him to court, again, and have the agreement modified to reflect:

1. The method of delivery of the check,

2. The place of delivery; e.g., to your new address and if any changes of address take place in the future, then upon written notice, to that new address.

Otherwise, as long as he know that he's living up to his end of the bargain by paying on Fridays, then there's nothing else you can do. If your parents refuse delivery, then he'll just drop the payment at their feet anyway. Delivery completed.

Thank you I have to take him to court next month( when I have the money) so I will throw that in also.
