| I am from Colorado. My husband's ex wife collected welfare for about 3 yrs claiming that he did not live with her and there one child. He did live with them and was the only one working. They recently got a divorce and the subject came up, the first he had heard about it, and the courts wnated him to pay child support. Knowing the their mother had less financial means than he, he went ahead and said he would pay the child support for that time period. His main concern was getting custody of their two children. The state has been garnishing $23+ from his pay checks, but now he got a letter saying that he has 30 days to come up with the full amount of $4,000+ or they are going to take his income tax refund. Now he has to pay for helping her out when she caused the problem in the first place. What rights, if any, does he have in this situation? Please help!!! | WHAT STATE ARE YOU IN? I believe you can turn her in for welfare fraud still, but it may come back on you**************unless you "knew" nothing about it. Also, if you owe that much in *back Support* you already are *red-flagged* with the IRS to have your returns seized, and given to her. The IRS can take up to 50% of your pay, per pay period. UNLESS! You already have an arrangement in writing with the Child Support Enforcement Agency. You need to call them and talk to your case worker, who can in turn call the IRS and take the red flagg off and/or stop them from taking 50% out of your checks. Also you should ask for a complete audit of your case as to where all monies are applied that you send. Good Luck, U |

Good Luck, U [/b]<HR></BLOCKQUOTE> I forgot to mention that no matter what amount of arrears you have, your income tax will be flagged and ONLY when that arrearage is paid in full will the 'think' about stopping the flag, you have to get on them to stop it (after the arrears arre paid in full) |
