i have a daughter who is nine years old. I have also paid child support directly to the mother. recently the mother forged my name on a loan and received the money. i told her that until she paid off the loan i would not give her any more money. she decided to take me to court for a court ordered child support. now i pay $475 per month. during those three months prior to court i did not pay any support to the mother. but once it went to court i was ordered to pay those three months in arrearage as well as my monthly support payments. i do not think that is fair. how can i cease that arrearage or get that erased from the courts.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Lots of stuff going on here, but let me see if I can break it down simply and clearly for you.

Basically, there is a young child in the picture here: do not treat your daughter as the bad guy, do not make her feel like she is torn between her mom and dad. Trust me, children feel and know it.

Now, your child support payments HAVE NOTHING TO DO WITH WHAT YOUR EX WIFE DID! DO NOT TAKE IT OUT ON YOUR DAUGHTER OR MAKE HER SUFFER FOR IT BY TAKING AWAY HER CHILD SUPPORT PAYMENTS. The court was correct in making you pay child support arrearage. You did the wrong thing by stopping money.

Now, if you know your Ex did this and forged your name on a loan and you are concerned about how it will affect your credit report/whether she will default on the loan, may I suggest the followin:

Put in a dispute letter/phone call to every credit reporting agency disputing this loan.

THen, contact an attorney who is experienced in white collar crimes like this: forgery. To find such a lawyer: look it up in attorneypages.com or contact your STATE Bar Association and ask for the lawyer referral program. At that point, you tell them what happened:

They will either decided to pursue this matter with a civil suit or decided both a civil suit and pressing criminal charges will be done.

EITHER WAY REMEMBER THE REPERCUSSIONS THIS WILL HAVE ON YOUR DAUGHTER.
