I am paying child support based on pay from 2 and 3 years ago. My job is commision only. I tried to explain this to the judge but it didnt help. This year my pay has gone down $14,000 compared to the amounts I was making in the past. Because of the job I have, my year to date can change for better or worse every year based on people buying cars. What can I do to get my support lowered enough so I can live? This year my year to date is only $12000. I am paying $600 a month in support.

My response:

Unfortunately, you can't. Your CS payments have been "imputed" based upon your "ability to earn", and not your actual income. Your children's needs, and their related costs, don't fluctuate - - i.e., food costs do not go up and down, and housing and clothing basically cost the same without fluctuation. While you didn't mention their ages, one thing is for sure; as your children grow older, so will their demands and needs grow - - costing even more money.

A judge will not lower your CS based upon your current situation. The best you'll be able to do under such circumstance is to obtain a better paying, and more stable paying, job. It might be a good idea to start your job search as soon as possible because, like I said, the needs and demands of your children upon your financial support are only going to grow, as they get older. It's time to look to the future.
