My ex husband owes over $16,000.00 in back child support. However he is currently making partial payments on current support, very seldom is it the court ordered amount and very seldom does he pay it monthly. Our daughter is entering college soon and this money would come in very handy. Last week I contacted a legal service that "specializes" in child support recovery. I was told that as long as my ex husband is making partial payments I cannot legally go after the back support. Can someone tell me if this is true? Any help would be appreciated.

Without a State name, it would be difficult to assist you. Laws are different everywhere.

hmmmm, again i am not a legal advisor, however, i am presently going through the same scenario. my attorney told me that he will go after the backpay of childsupport, in my case abt $13.000.- from my ex. he stated that the ex has to continue to pay what he has been paying plus the back childsupport, the partial payment thing won't cut it. i asked him what happens if the ex just decides not to pay, and i was told that in such a case, the employer would be contacted and the money would be taken out of my ex's pay. TRY THAT !!. then again i am in texas and the laws vary from state to state.

This is not true. I suggest you either contact the DA's office or get your own attorney to progress this..
