Question

I am 21 and a single mom of two (1+3 boys)They have different fathers. A bit of backround: My 3yo was sexually abused my my 1 yo's father. 2 weeks before I had my youngest son. I took immediate actions It is currently being investigated still 1 and 1/2 years later (gotta love th courts and forensic)I have to go to court for child support of my younest son now I am concerned with a visitaion issue but do not know if I should be due to the fact I have a restraing order for myself and both of my sons and no paternity had been established legally so they allowed me to do it in civil court. I can't afford a lawyer nor do I really want one I am fighting from my heart they wouldn't be I have done some research but is there any info anyone has that may help me here in Massachusettes?

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Okay, well, basically, I applaud you for taking action and putting your heart into it. BUT, you need to establish paternity (it sounds like two different fathers and no marriage) in order to get child support. There is a presumption the husband is the father when married, but not so outside of marriage. Now, once you get that done, all of thse criminal investigations/temporary restraining orders will be a like a light bulb to the judge and will have some affect on your court order for visitation/custody.

You NEED TO GET AN ATTORNEY; IT IS THE ONLY WAY TO PROTECT YOUR RIGHTS. TRY ATTORNEYPAGES.COM OR YOUR STATE BAR. THERE ARE ATTORNEYS OUT THERE (VIA LEGAL AID/PRIVATE PRO BONO WORK) who give free representation.

I am sorry to say that is no longer enough. A good opposing attorney could tear you apart if you had no legal representation. You also have to ensure that beneath any emotional or moral argument, that you have points of law to back you up or at least facts with proof.

There is enough evidence to show that if anyone values the result, then you have no choice but to get an attorney.
