My child and reside in Louisiana. I have been faithfully paying my scheduled child support payments for the last year and 11 months. Recently my daughter's mother is threatening to take me to court because my payments are not exactly sent on the 1st and 15th as outlined in our court order. I have never missed a scheduled payment!! I have never been late not one month since the very beginning. However, I do have other bills that are due on the same dates as the 1st and the 15th. So I make my payment to her 3 to 5 days after the scheduled dates. (i.e., payment due on the 1st, I mail the check on the 3rd or 5th instead.) Do I have any legal backing on this issue? Please respond at your earliest convenience.

If it is court ordered, then she can proceed with legal action... however most courts will see this a petty action and not be thrilled at having to hear the case.. however, if she has the money to proceed then it will be heard and you will be given a slap on the wrist.

Look at the wording in the order, does it say sent on the 1st or by the 1st. If by the 1st and you post it on the 5th, then by the time it clears, you are nearly 10 days late. I am sure you do have bills, but remember, so does your ex.
