| First off, I'm certain I'm going to be needing a Family Law attorney very soon. I'm sure most of the other questions he will have to answer, but my first question is... I am living in Georgia, the non-custodial parent of 2 children who live with their mother in Illinois. The children were born in Florida and that is where the original child support documents were drawn up. Will I be able to find an attorney here in Georgia that can support me, or must I find one in Illinois? My Ex and I have had constant disagreements over child support, and they are rising to extreme levels. I feel that another trip to court is needed to clear the air and find the true, legal answers to multiple questions. If you know any answers to the following questions, please respond! Do I have to pay for braces? Do I have to pay for college? Do I have to pay for a car at 16? Do I have to pay for their health insurance? Do I have to pay 1/2 of any health costs not covered by insurance? It is my belief that these are covered as part of the child support. She demands I pay 1/2 of them (and all of health insurance). The latest blowup was over braces for the youngest. She called and told me the child was going to be getting braces, that her husband's insurance would pay all but $2000 and that she thought I should pay $1000. I discussed it with my current wife and we agreed to pay $500 since we had no input nor warning about it at all. Now she wants to take me to court to make me pay for that and many other things (major ones above). The GOOD thing is it got me off my butt to figure out what the guidelines for CS in Illinois are. Based on those guidelines, I'm paying well over the CS guidelines - so even if she forced me to pay for some of those items, my CS payments might be reduced in the process... Well, I'm meandering... Any help would be greatly appreciated. |

| I am living in Georgia, the non-custodial parent of 2 children who live with their mother in Illinois. Providing there are no current court action in progress and the children have been in IL for 6 months then further action will be in IL Do I have to pay for braces? Depends on your court order. If there is nothing, then no. Do I have to pay for college? Depends on the court order. If there is nothing specified then they MAY be a state law that implies it. Do I have to pay for a car at 16? If it is not in the court order then no. Never seen it in any court order. Do I have to pay for their health insurance? Depends on your court order. If there is nothing, then no. Do I have to pay 1/2 of any health costs not covered by insurance? Depends on your court order. If there is nothing, then I do not think so. It is my belief that these are covered as part of the child support. Considering that the moment you speak to an attorney she will have to pay a min of $500 then I see no point. Again, if there is nothing in the court order then it would be tough to get a judge to order you to pay. I suggest you have a very close read of the divorce and custody agreement. |
