| I live in PA. My partner's ex-girlfriend is suing for child support. They had no previous court order and were never married. He has made regular child support payments adding up to almost twice their verbally agreed amount (whenever she's asked for money he gives it to her. At least he did in the past) We have documented proof of all payments. My questions: does the extra funds he's given her have any bearing at all on future payments to be determined by the court? Also, he and I live together but are not yet legally married. Does my income have any impact on the support amount? Finally, once the amount is set by the court, is there any legal reason for him to give her extra money just because she wants it? thanks! |

| Your fiance will need to go to court and get a proper child support order in place. The court will take many things into consideration, including how much he's paid, his monthly income, etc. You both should keep the receipts of all that he's paid to his ex in the past. ------------------ I am a law school graduate.
