Question


I was divorced in 1996. My ex
husband got physical custody, we
have joint legal custody, and I
have unlimited visitation rights.
Unfortunately, he moved from MA to
MD over 3 years ago. I have seen
my daughter frequently, but his
financial situation has made it
inconsistent. He left the state
without my consent nor with a
court order. I want physical
custody. Is it possible? Does MA
have jurisdiction? Will I be able
to get a temporary order for
physical custody pending my
complaint for modification? Can I
use the fact that he took her out
of state without consent in any
way, especially since it is a huge
interference with my unlimited
visitation rights? His financial
situation is bad, much worse than
mine, can I use this to help my
daughter? Does MD have any
jurisdiction even if no court
orders or action has been
presented there?
