My child turns 21 this July. She lives in NY with my ex. Do I have to file a modification for child support to discontinue paying when the time arrives?

Yes, even if the original support order says it terminates on her 21st b-day. You probably won't need a lawyer, though.

This is not legal advice and you are not my client. Double check everything with your own attorney and your state's laws.

Thumbs down

Well? I don't know what state you are from, but here in Wisconsin. The child is done with (child Support) when it turns 18, or graduates from High School, either, or. Yes you will have to go back to court & get the order modified. Hope I was of some help?

My response:

Not so fast Ron. Child support continues if the child goes on to college full time, and then stops at age 21.

IAAL: Is that a state law, or is that a "general" law? Is it something new? If I had custody papers that say child support ends when the child turns 18, or graduates from high school (whichever occurs last) does the going to college fulltime child support override that? Or are we out of luck? The state is Iowa.
