| well this is the problem that my husband and i r having,his ex wife have joint coustdy and the oldest child wishes to live with her father,not because she gets away with things. the ex had a paper drawn up that the child could come live with us and go to school but the catch is we still have to give her the money for the child,the ex lets the girl walk the streets at 12 at nite,leaves her alone and much more,my question is if we dont sign the paper and the girl stays with the mom we feel something bad will happen what do we do? thank you |

| Get a copy of that paper she has drawn up. It will add weight for you to file for a change in physical custody. If the child resides with you then you should not have to pay her any child support. In fact, she would have to pay you. Give her a counter proposal, the custody is changed so that you have physical custody and in return you will not make her pay any child support. If she refuses, then file for a change in custody. Make sure you document everything and also any examples of neglect. That is unless of course you do not want to risk losing in court and have no problem paying her x amount for the next 6 years. |
