My sister who is going through a divorce in CA is having the judge force her to sign a quit deed on her property rights. Her husband who is very rich has manipulated everything and we suspect our lawyer too. The lawyer refuses to do anything and as he is on contigency basis as she has no money we are helpless. The judge has said that he will throw her in jail if she does not sign this quit document as she will be in contempt of what he is asking her to do. He will not listen to any of her plea's and is not going to award her any community property.
What should we do ?? We are not residents of the USA and our lawyer says that this is how the justice system in America works and we should live with it!!
PLEASE HELP US WITH ADVICE

What county is this in? This sounds like a bad movie of the week! California is a community property state, which translates into 50-50.

On what basis does the judge claim to be able to force this quit-claim? I'm assuming the husband is asking for the house, that's his right, but the wife has the right to refuse. That leaves at least two options: sell the house and split the proceeds, or one spouse buys out the other's interest in the house.

If there are children involved, the court looks at the numbers: what he makes, what she makes, then they meet somewhere in the middle for the support of the child(ren).

If there are no kids, they'll look at what each brought into the marriage separately, what they accumulated during, then what they acquired after (as separate.) That holds true for debts as well as assets.

I can't believe the judge can find her in contempt if she doesn't sign over the house, unless perhaps it was his sole property at the time of the marriage.

It sounds like you could use a new lawyer. Good luck.

Thanks for the reply. Are there any lawyers in Marin county in San Fransisco who do pro bono work. Her husband is loaded and we are scared has manipulated the legal system. We need someone strong to fight him who could do it on a pay when win basis. Is that possible ??
