Question

Married in Ark.in Oct. 99.Wife preg. prior to marriage. Wife left Ark. in Nov. 99 to move to La. Child born in La. in Feb. 2000. Divorce filed in Ark. Mar. 2000. Wife state not sure child in husband. Husband get court order for DNA test. Test done in July 2000. Husband is father. Meantime the wife filed for sole custody in July 2000 in La. Questions: 1. Which state has jurisdiction of the child custody? 2. Is there anyway the mother can get sole custody if the father has not committed in crime. The mother stated in the suit that the father has not made any attempt to visit, but the father did visit until the mother made the statement that she was not sure in May. 3. can the mother be made to meet the father half way in the visitation visits?

My response:

If the child was born in LA, then it is that State that has jurisdiction. As to your other questions, those are matters for a judge's decision in that State. Hire a LA attorney to Petition for visitation and child support.

If there was a divorce petition filed in AK in March then surely the petition in CA in June is invalid as action is pending in another state ?? or would that only be the case if within the divorce petition was also a petition for custody ?

If not.. how can you progress divorce in one state and custody in another ?
