Question

My son is going through a divorce and custody for his 2 year has not been established. Since the separation (5 mos. ago) the baby has been living with my son and the mother has been getting the baby on a average of twice a week. The mother took off to her birth state ( North Carolina )with the baby last Sunday and then called my son and said she would not be returning. Can she do that? What can my son do to get the baby brought back to Tennessee?

Needing any info desparately!

Get an attorney, go to court, and have custody/visitation papers drawn up NOW, otherwise, Mom can come in and take child when she wants to. But be fair, and compromise with Mom. And keep best interest of child on top.

This is just advice, and my opinion.

Kilzer - what state are you in? Was there any divorce papers filed? Were they married? Did the mother leave your son and grandson without cause? Were there any police reports, etc., filed before or after?

We reside in Tennessee.

No, to the the divorce papers. Both parties have talked with Attorneys but neither have filed.

Yes, they were married.

The mother was having an affair.

There was never a cause for police reports.
