which brings me to my next question: should the father ever have the child in his possession, he also would not be legally responsible to return the child to his mother without a court order- correct?

that's the problem. the mother is completely denying him any visitation with his child whatsoever. this is not orthodox and she has no reason or right to deny him any and all visitation with his bilogical son. there must be something he can do in the meantime - while the courts take so long...
